Better Me Terms Of Service
1. PLEASE READ THIS LEGAL DOCUMENT CAREFULLY
Better Me Bariatrics, LLC, a Wyoming limited liability company (“Better Me,” “we,” “us,” or “our”) provides medical tourism facilitation services for individuals seeking bariatric procedures in Latin America, as well as related non-medical health and wellness services and bariatric supplements, through the Better Me website (https://bettermejourney.com) and any affiliated digital properties (collectively, the “Better Me Sites”), including mobile, desktop, or device
applications (the “App” or “Better Me App”), and Better Me-controlled social media pages (e.g., Facebook, Instagram). Together, these services and platforms are referred to in these Terms of Service (“Terms”) as the “Better Me Service” or the “Services.”
By registering for any service with Better Me, or by visiting, browsing, or using any aspect of the Better Me Service, you (“you,” “user,” or “patient”) acknowledge that you have read, understood, and agree to be bound by these Terms, creating a binding legal agreement between you and Better Me.
PLEASE NOTE: SECTION 20 OF THESE TERMS CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER. THIS AFFECTS YOUR RIGHTS. UNLESS YOU OPT OUT AS DESCRIBED IN THAT SECTION, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS AND AGREE TO INDIVIDUAL ARBITRATION OF DISPUTES.
If you do not agree to these Terms, you may not use the Better Me Service. Additional terms may apply to certain parts of the Better Me Service, and by using those services you agree to the additional terms, which are incorporated into these Terms by reference.
2. SALE OF PRODUCTS
a. If you purchase any products or services through the Better Me Service, your purchase is governed by our Product Purchase and Return Policy, which is hereby incorporated into these Terms. By submitting payment, you agree to the terms outlined therein.
b. Product availability is not guaranteed. Descriptions, images, and availability of products and services may change without notice. Illustrations are for reference only and may not reflect actual items. We reserve the right to correct errors and to revoke or adjust any offer at any time.
c. Payment is due at the time of order unless otherwise noted. Products will be shipped to the address you provide. We may cancel your order prior to shipping for any lawful reason and will refund prepaid fees if we do. You may receive an order confirmation via email or through your Better Me account dashboard. Please refer to the Product Purchase and Return Policy for full details.
3. WHO MAY USE THE BETTER ME SERVICE
a. Age Requirement. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to register and use the Better Me Service.
b. Eligibility. We reserve the right to deny access to the Better Me Service to any person or entity at our sole discretion. You are responsible for complying with local laws when using the Better Me Service. The Service is provided for personal, non-commercial use only.
4. LICENSE TO USE THE BETTER ME SERVICE
a. License. Subject to compliance with these Terms, Better Me grants you a limited, nonexclusive, non-transferable, revocable license to access and use the Better Me Service for personal, non-commercial purposes. This includes viewing publicly available content and downloading the Better Me App to one personal device. This license is conditioned on your agreement to the Better Me Intellectual Property and DMCA Policy (Section 19) and remains valid unless revoked.
b. Restrictions. Except where expressly permitted in writing, you may not reproduce, reverse engineer, modify, distribute, or use the Better Me Service or its content for commercial purposes. All rights not granted by Better Me are reserved.
5. PRIVACY
Your use of the Better Me Service is governed by our Privacy Policy, which is hereby incorporated into these Terms.
The Privacy Policy explains:

iii. With whom and under what circumstances we share that information

6. LINKS AND THIRD-PARTY WEBSITES
a. Links provided through the Better Me Service to third-party websites are offered solely as a convenience. By clicking such links, you leave the Better Me Service. We do not control or endorse any third-party sites and disclaim all responsibility for their content, services, and practices. You access third-party websites at your own risk.
b. Any dealings you enter into with advertisers or third parties found on or through the Better Me Service—including payment and delivery of goods or services—are solely between you and the third party. We are not responsible for any loss or damage incurred as a result of such dealings.
c. You may link to the homepage of https://bettermejourney.com only if the link is fair, legal, and does not damage our reputation or imply an endorsement without written consent. We reserve the right to revoke linking permission at any time.
7. MEMBERSHIP REQUIREMENTS AND REGISTRATION
a. To access certain features of the Better Me Service—including travel coordination, procedure bookings, and patient resources—you must register as a member and, where applicable, subscribe to a service plan. You agree to provide accurate and complete information and to keep it updated. Failure to do so may result in suspension or termination of your account.
b. Profile Information and Picture. You may not use another person’s name, likeness, or personal information. Offensive, obscene, or unlawful profile content is strictly prohibited and subject to removal.
c. Account Security. You are responsible for any activity under your account. Keep your password confidential. If you suspect unauthorized access, update your credentials immediately and contact our support team at support@bettermejourney.com.
8. MEMBERSHIP STRUCTURE AND FEES
a. Information on current membership tiers, pricing, and benefits is available at https://bettermejourney.com or through other official Better Me communications. We may change our pricing or features at any time, with or without notice.
9. TERMINATION; ACCOUNT DELETION
a. Term. These Terms apply for as long as you have an account with Better Me and/or use the Better Me Service.
b. Termination. Better Me may suspend or delete your account or restrict your access if you violate these Terms or engage in conduct that may harm our reputation. Deleted accounts may not be reactivated without written approval.
c. Effect of Termination. Upon termination, all licenses granted to you will be revoked. The following sections survive termination: Privacy (Section 5), Intellectual Property (Section 19), User Content (Section 10), No Warranties (Section 16), Limitation of Liability (Section 17), Not Healthcare Advice (Section 18), Indemnification (Section 14), Arbitration and Class Action Waiver (Section 20), Governing Law (Section 21), and General Provisions (Section 22). Better Me is not responsible for deleted user data or content after termination.
10. USER CONTENT
a. “Content” refers to all text, images, audio, video, data, or other materials posted or made available through the Better Me Service. “User Content” means content you (or other users) submit.
b. You represent that your User Content is truthful, lawful, and in compliance with these Terms. Better Me disclaims liability for any damage or loss resulting from your access to or reliance on any Content, including User Content.
c. You retain ownership of your User Content but grant Better Me a worldwide, perpetual, royalty-free, irrevocable license to use, display, modify, distribute, and make derivative works from your content in all media. You waive any moral rights and agree that Better Me may use your feedback, reviews, or suggestions for any purpose without compensation. Other users may view your content for personal, non-commercial use.
d. You may delete your User Content, but it may remain in backups or archives, or in places where it was shared publicly. Better Me is not obligated to delete residual copies or reposts of your content by other users.
11. RIGHTS AND TERMS FOR APPS
a. Rights in App Granted. Subject to your compliance with these Terms, Better Me grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Better Me App on a personal device that you own or control. This license is solely for personal, noncommercial use. You may make a reasonable number of backup copies. You may not:
1. Copy, modify, or create derivative works based on the App;
2. Distribute, sublicense, lease, rent, or otherwise transfer the App to third parties;
3. Reverse engineer, decompile, or disassemble the App;
4. Make the App available to multiple users or systems outside of the scope of your personal use.
b. Reservation of Rights. Better Me retains all rights in and to the App not expressly granted to you under these Terms.
c. App Store Terms. If you download the App from any app store (e.g., Apple App Store or Google Play), the following apply:
1. These Terms are between you and Better Me, not the app store provider;
2. The app store has no obligation to maintain or support the App;
3. The app store is not responsible for claims relating to the App;
4. In the event of failure, your only remedy may be a refund from the app store;
5. The app store and its affiliates are third-party beneficiaries of these Terms;
6. You warrant that you are not in a U.S. embargoed country or listed on a U.S. Government restricted list;
7. You must comply with all app store terms and third-party terms of service.
12. GENERAL PROHIBITIONS AND ENFORCEMENT RIGHTS
a. Prohibited Conduct. You agree not to use the Better Me Service to:
1. Infringe intellectual property or privacy rights;
2. Violate any law or regulation;
3. Post false, deceptive, defamatory, or offensive content;
4. Promote hate speech, harassment, or violence;
5. Exploit minors;
6. Distribute spam or malware;
7. Access or tamper with non-public areas or systems;
8. Scrape or extract data through bots or automated tools;
9. Misrepresent your identity or affiliation;
10. Compete with Better Me directly or indirectly;
11. Use the Better Me Service for commercial purposes without our written consent.
b. Enforcement Rights. We may monitor, remove, or block access to any content or account at our sole discretion. We may also report violations to legal authorities. These enforcement rights are not an obligation but are reserved for ensuring safety, compliance, and reputation.
13. DEALINGS WITH THIRD PARTIES
a. Your communications and transactions with any third party—including providers, advertisers, partners, or other users—are solely between you and that party. Better Me is not liable for any loss, damage, or injury arising from such interactions.
14. INDEMNIFICATION
a. You agree to defend, indemnify, and hold harmless Better Me, its affiliates, officers, agents, employees, and contractors from any claims, damages, losses, or expenses arising from:
1. Your use or misuse of the Better Me Service;
2. Any content you submit or transmit;
3. Your violation of these Terms or applicable law;
4. Your interaction with third parties.
15. THIRD-PARTY LINKS AND CONTENT
a. The Better Me Service may contain links to or content from third-party websites. These are provided for convenience only. Better Me does not endorse or control third-party sites and is not responsible for:
1. The accuracy, legality, or quality of third-party content;
2. Any loss or harm arising from accessing or using such content;
3. Any product, service, or resource linked or advertised via third-party websites.
16. NO WARRANTIES
a. Better Me reserves the right to modify or discontinue any part of the Better Me Service at any time, including content, features, pricing, or accessibility. You are responsible for ensuring that your own devices and internet access are compatible with our Service.
b. The Better Me Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, Better Me disclaims all warranties—express, implied, statutory, or otherwise—including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not guarantee that:
1. The Service is legal or available in your jurisdiction;
2. The Service will be uninterrupted, secure, or error-free;
3. Any content will be accurate or reliable;
4. User-generated content will be safe or appropriate;
5. Your use of the Service will meet your expectations;
6. We will maintain any specific features.
c. Any disclaimer or limitation not allowed by law is limited to the minimum extent required by law. All warranties, to the extent applicable, expire 30 days from the first use of the Better Me Service.
17. LIMITATION OF LIABILITY
a. To the fullest extent allowed by law, Better Me shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including (but not limited to) damages for lost profits, goodwill, data loss, service interruptions, system failures, or inability to use the Better Me Service, even if advised of the possibility of such damages.
b. If liability is found, it shall apply solely to Better Me Bariatrics, LLC—not to any parent company, officer, employee, or affiliate.
c. Better Me’s total aggregate liability for any claim shall not exceed the total amount you paid to Better Me in the twelve (12) months preceding the claim.
d. Some jurisdictions do not allow the exclusion of certain damages. If so, some limitations above may not apply, but all others shall remain in force.
18. NOT HEALTHCARE ADVICE
a. The Better Me Service does not provide medical advice, diagnosis, or treatment. The Services—including content, resources, and recommendations—are for general informational purposes only and should not replace professional medical advice.
b. Always consult a licensed healthcare professional before making decisions regarding your health, bariatric surgery, medications, or related treatments. Do not delay or avoid seeking professional care because of something you read or hear via the Better Me Service.
c. The statements and products referenced on the Better Me Service have not been evaluated by the U.S. Food and Drug Administration (FDA) unless explicitly stated. They are not intended to diagnose, treat, cure, or prevent any disease.
d. You are responsible for consulting with your physician before using any supplements, starting a diet or fitness regimen, or undergoing any procedures facilitated through Better Me.
e. Any comments made by Better Me staff in forums or reviews are personal opinions, not medical endorsements. These do not represent the views of Better Me as a company or any healthcare professional.
19. BETTER ME INTELLECTUAL PROPERTY AND DMCA POLICY
a. Better Me respects intellectual property rights and expects users to do the same. If you believe any part of the Better Me Service infringes your copyright, please send a detailed notice to support@bettermejourney.com.
b. All content, code, visuals, software, branding, data, and materials within the Better Me Service (collectively, “Better Me IP”) are owned by Better Me or its licensors. You may not use, copy, distribute, or alter any part of the Service without written permission.
c. The “Better Me” name, logo, trademarks, trade dress, and service marks are the exclusive property of Better Me Bariatrics, LLC. No license is granted to use these without our express written consent.
d. Any permitted usage must:
1. Preserve all proprietary notices;
2. Not modify logos or trademarks;
3. Not create confusion or imply endorsement;
4. Not be used as part of another service or product name;
5. Clearly attribute Better Me branding if required.
e. Unauthorized use of Better Me IP—including logos, designs, and trademarks—is strictly prohibited and may result in legal action.
f. You may not produce or sell merchandise containing Better Me branding or trademarks (e.g., apparel, mugs, bags) without a license.
g. Better Me reserves all rights not expressly granted in these Terms.
20. ARBITRATION REQUIREMENT & CLASS ACTION WAIVER
a. Mandatory Arbitration. You and Better Me agree that any dispute, claim, or controversya rising out of or relating to these Terms or your use of the Service (“Dispute”) will be resolved by binding, individual arbitration, and not in court or class action. This agreement is governedby the Federal Arbitration Act and Wyoming law.
b. Exceptions. You may:
1. Bring an individual claim in small claims court (if eligible);
2. Seek injunctive relief for intellectual property violations.
c. Notice of Dispute. Before arbitration, you agree to notify Better Me of your claim in writing via certified mail to:

Allow 45 days for resolution before initiating arbitration.
d. Arbitration Process. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules. One arbitrator (a retired judge or licensed attorney with 10+ years’ experience) will be selected. Hearings will be held in Sheridan, Wyoming, unless agreed otherwise.
e. Costs. JAMS fees and arbitration costs shall be governed by JAMS rules. The parties agree to split arbitration costs unless the arbitrator rules otherwise.
f. Class Action Waiver. YOU AND BETTER ME AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS
ACTION OR CLASS-WIDE ARBITRATION. If this clause is found unenforceable, all of Section 20 shall be void.
g. Changes. If Better Me modifies this Section after your initial acceptance of these Terms, you may reject the change by written notice within 30 days. Arbitration will then proceed under the prior version.
h. Severability. Except for the class action waiver, if any part of Section 20 is deemed unenforceable, the rest shall remain in full effect.
21. CONTRACTING ENTITY, GOVERNING LAW AND JURISDICTION
a. Unless otherwise stated in additional terms, you are entering into this agreement with Better Me Bariatrics, LLC, a Wyoming limited liability company, and all services are provided under this entity.
b. These Terms are governed by and shall be construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
c. Except for claims required to be arbitrated (as described in Section 20), any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those
courts.
22. INTERPRETATION; SEVERABILITY; WAIVER; REMEDIES
a. Headings are for reference only and do not affect the meaning of any provision.
b. If any provision of these Terms is found to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remainder of the Terms shall remain in full force.
c. No failure or delay in exercising any right or remedy shall operate as a waiver of that right or remedy.
d. Better Me’s rights under these Terms are cumulative and not exclusive of any other legal or equitable rights or remedies.
23. SUCCESSORS; ASSIGNMENT; NO THIRD-PARTY BENEFICIARIES
a. These Terms are binding on and inure to the benefit of the parties and their respective successors and permitted assigns.
b. You may not assign or transfer these Terms without the prior written consent of Better Me.
c. Better Me may assign these Terms at any time, with or without notice, to any affiliate or successor in interest.
d. There are no third-party beneficiaries to these Terms, unless expressly stated otherwise.

a. You agree to receive communications from Better Me electronically, including legal notices, billing statements, and disclosures.

25. MODIFICATION
a. Better Me reserves the right to update or modify these Terms at any time. We will notify users of changes by posting the updated Terms on https://bettermejourney.com, with an updated “Last Revised” date.
b. Continued use of the Service after updated Terms are posted constitutes your agreement to the new Terms. If you do not agree, you must discontinue use of the Service.
c. Certain features may be modified, added, or removed from the Better Me Service without notice.
26. ENTIRE AGREEMENT
a. These Terms, along with the following incorporated documents, constitute the entire agreement between you and Better Me with respect to the use of the Better Me Service:

2. App Membership Terms (if applicable)
3. Product Purchase and Return Policy
4. Medical Services Facilitation Agreement (if applicable)
b. In the event of any conflict between these Terms and additional policies or notices, these Terms shall control unless otherwise stated.
27. FORCE MAJEURE
a. Better Me shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, fire, flood, war, terrorism, pandemics, government actions, labor disruptions, or cyberattacks.
b. Affected performance deadlines will be extended by a period equal to the time lost due to the force majeure event, provided that the affected party is not at fault and takes reasonable steps to resume performance.
